These terms and conditions constitute the agreement between the customer and Lilygates Cake and Food Services. By making a payment through this invoice, the customer acknowledges and agrees to these terms and conditions. Please note that these terms and conditions are subject to change without prior notice.
PAYMENTS
- All sales are considered final.
- Payments are non-refundable, and store credit can only be issued by Lilygates Cake and Food Services Management. For any refund or store credit requests, please submit them in writing via email to info@lilygatescakes.com. Lilygates Cake and Food Services has 14 days to review your request and provide an outcome via the email address of the requester.
- The initial deposit secures your event date, is non-refundable, and non-transferable. It cannot be converted to store credit or applied to future dates. As we accept your event order, we initiate the process of declining other orders. As your event date approaches, re-booking your date becomes increasingly unlikely.
- Final payments must be received within the specified timeframes below. Reservation deposits should be received within 72 hours of invoice receipt. Final payments are due on the date indicated in the invoice.
WEDDING ORDERS
- When placing an order 14 days or more in advance, a 50% non-transferable deposit is required to confirm your reservation. Final payment is due fourteen (14) days prior to the event date.
- For orders placed within 14 days of the event date, full payment is required to confirm your reservation. If the event is postponed, please submit the new event date no later than 30 days prior to the event. The remaining balance will be divided into two equal payments. The first payment is due on the ORIGINAL due date, and the second payment is due fourteen (14) days before the NEW event date.
OCCASIONALORDERS (birthday, shower, anniversary, etc.)
- When placing an order 14 days or more in advance, a 50% non-transferable deposit is required to confirm your reservation. Final payment is due seven (7) days before delivery or pickup of the items ordered.
- For orders placed within 14 days of the event date, full payment is required to confirm your reservation.
MENU TO BE SERVED
The parties have agreed to the menu that was invoiced to the clients. Caterer reserves the right to make small changes to the menu, if key ingredients are unable to be served due to reasons beyond the control of the parties. Any changes to change an agreed-upon dish beyond a reasonable recognizable flavour presentation will be discussed with the client to obtain approval before sourcing ,preparing or serving.
No alcoholic beverages will be served without a separate agreement. No alcohol will be provided by the caterer.
LEGAL COMPLIANCE
Lilygates cake and food services will work in compliance with all applicable local health department rules and regulations relating to food preparation and food service.
INSURANCE AND INDEMNIFICATION
Lilygates cake and food services has or will obtain general liability insurance relating to caterer’s services at the event. However, client will indemnify and hold harmless lilygates cake and food services staff for any damage, theft, or loss of property occurring at the event, caused by any of client’s guests.
CHANGES
- The final date for changes related to the menu size, flavor, style of food and cake is 30 days before the event. Any changes after this date cannot be guaranteed and may be subject to additional charges.
- All changes to existing orders must be submitted in writing via email only. Changes communicated via phone, social media messaging, text, etc., will not be honored.
- Seasonal items may incur an additional charge or may be substituted if unavailable.
VARIATIONS
- While Lilygates Cake and Food Services makes every effort to provide the flavor, filling, decoration, size, color, shape, and design as discussed during consultations, cake creation is an art form and may be subject to variations.
- If the customer supplies an image or likeness to be created, Lilygates Cake and Food Services will make every attempt to make the item as close to the likeness as possible. In cases where the product requires equipment or ingredients that cannot be obtained within the time allotted (exotic flavors, molds, shapes, stamps, texture, additional novelty such as glitter), the closest available resemblance will be used to complete the product.
- Color matching is not an exact science, and different sugar substrates absorb color differently. Lilygates Cake and Food Services will strive to make substrates match each other and provided color swatches, but a 100% perfect color match may not always be achievable using food-grade dyes.
- Lilygates Cake and Food Services cannot match a “verbal” color or a color sent via electronic devices, as all monitors display color differently. To attempt a color match, a color swatch must be provided 14 days in advance of the event.
- To maintain the stability and integrity of your event cake, Lilygates Cake and Food Services reserves the right to make design and structural changes to your cake on-site or off, without prior notification.
SITE & VENUE CONDITIONS
Lilygates cake and food services will need to have access to the venue no later than 1 hour in advance of the start for the event and 1 hour after the end time for clean up. Clients will make necessary arrangements at client’s expense to get this access arranged.
- Lilygates Cake and Food Services reserves the right to refuse the setup of a cake in any location that is not adequately air-conditioned or weatherproof or on any cake plateau or stand that does not appear sturdy enough to hold the weight of our cakes. All efforts will be made to work with venue staff to find a placement better suited for your cake to ensure it looks beautiful on your arrival.
- Cake is heavy and requires a perfectly level and sturdy table and cake plateau/stand. Lilygates Cake and Food Services is not responsible for any damage caused by tables or cake plateaus/stands that are unable to withstand the weight of our cakes or are improperly installed or installed at a lean.
- Once cakes are set up, they are not intended to be moved until served. Lilygates Cake and Food Services is not responsible for damage caused by others after the cake is set up by Lilygates Cake and Food Services staff.
- Tall cocktail tables are not suitable for tiered cakes over 2 tiers tall and are not recommended, as someone will have to climb a ladder to both set up the cake and again at the reception to disassemble and serve your cake.
- Please be aware that 5-tiered or larger cakes on a standard height table may require a step stool or step ladder to disassemble and serve.
RIGHTS & WAIVERS
- Lilygates Cake and Food Services reserves the right to take photos of the product for display or promotional purposes without the customer’s consent.
- Lilygates Cake and Food Services is not responsible for any damage to the cake after delivery/set up is complete. Cakes are heavy and require a climate-controlled environment (at or below 75 degrees).
- If flowers are provided by an outside source, the arrangement of the flowers is included in the delivery fee. It is acknowledged by Lilygates Cake and Food Services and the customer that fresh flowers are not a food product and may contain pesticides, dirt, insects, and other contaminants.
- If the customer chooses to pick up the cake, the customer is responsible for the cake as soon as it leaves Lilygates Cake and Food Services’ premises. Upon visual inspection of the cake and its departure from the premises, the customer approves the cake’s visual appearance and waives any rights to a refund based on the style, design, or visual appearance of the cake.
- The product may contain or come into contact with milk, wheat, nuts, soy, and other allergens. The customer is responsible for notifying the guests. Lilygates Cake and Food Services is not responsible for any adverse effects of allergic reactions.
- In the event of a natural disaster, accident, or other situation outside of Lilygates Cake and Food Services’ control, this contract may be voided.
- Lilygates Cake and Food Services will strive to provide its services professionally and ensure a high level of customer satisfaction. In cases where our products or services do not meet our standards, or the client is dissatisfied, we may, at our discretion, provide the amount paid for those products and services in the form of store credit. Lilygates Cake and Food Services’ total liability is limited to the amounts paid for its goods and services. We will not be liable for any special, incidental, punitive, or consequential damages, whether foreseen or unforeseen, regardless of the basis of liability, such as breach of contract, breach of express or implied warranty, negligence, strict liability, tort, or otherwise.
- Only items, actions, and dessert details explicitly listed in the invoice are guaranteed by Lilygates Cake and Food Services.
EQUIPMENT RENTAL
- Equipment rental prices include a rental fee and a deposit. If the rented items are returned to Lilygates Cake and Food Services within 3 days, the deposit will be returned to the customer electronically. If the item is not returned within 3 days, the customer forfeits the deposit. If shipping the items back to Lilygates Cake and Food Services, the customer will have 5 business days and must provide a shipping tracking number via email when shipped.
DISPUTES & GRIEVANCES
- All disputes and grievances related to service provided or products delivered must be submitted in writing via email within 7 days of the date of service.
- All food sales are final. All payments are non-refundable. Any compensation provided in response to a dispute or grievance will be in the form of store credit only.
- The Parties will attempt in good faith to resolve any dispute or claim through negotiations between a director of each Party with authority to settle the dispute. If the dispute cannot be settled amicably within thirty (30) days, then the remaining provisions of this clause shall apply.
- The determination of the arbitration entity is final and cannot be disputed further.
- The performance of this Agreement shall continue during arbitration proceedings or any other dispute resolution mechanism. No payment due or payable by the customer shall be withheld on account of a pending reference to arbitration or other dispute resolution mechanism except to the extent that such payment is the subject of such dispute.
CANCELLATIONS
- Any cancellations must be made 72 hours in advance in writing and will result in store credit ONLY.
